They govern your access to and use of the GetBeta website and services (the "Platform"). By creating an account or using the Platform, you agree to these Terms, our Privacy Policy, and our Participation Agreement & Release of Liability (the "Participation Agreement"), which is incorporated by reference. If you do not agree, do not use the Platform. 1. WHAT GETBETA IS. GetBeta is a platform that helps independent people find each other and arrange their own outdoor activities and meetups ("Events"). We are only a venue. We do not organize, lead, supervise, guide, or attend Events, and we do not employ or control Hosts or participants. Please read the Participation Agreement carefully — it describes important limits on our responsibility and your assumption of risk. 2. ELIGIBILITY & ACCOUNTS. You must be at least 18 years old and able to form a binding contract to use the Platform. You are responsible for your account, for keeping your login secure, and for all activity under your account. Provide accurate information and keep it current. You may sign in with Google or with an emailed sign-in link. 3. ACCEPTABLE USE. You agree not to: (a) harass, threaten, stalk, defraud, or harm any person; (b) post false, misleading, illegal, hateful, or infringing content, or impersonate anyone; (c) misrepresent your identity, skills, or experience; (d) use the Platform for any unlawful purpose or to organize unlawful activity; (e) spam or send unsolicited messages; (f) scrape, crawl, harvest data, or access the Platform by automated means except as we permit; (g) attempt to breach security, probe, disrupt, or overload the Platform, or circumvent rate limits or access controls; or (h) violate any applicable law or the rights of others. 4. USER CONTENT. You retain ownership of the content you submit — events, messages, comments, and profile information ("User Content"). You grant GetBeta a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content as needed to operate and provide the Platform. You are solely responsible for your User Content and represent that you have the rights to submit it and that it does not violate these Terms or any law. We do not endorse User Content and are not responsible for it. 5. EVENTS. Events are created and run entirely by users. Hosts set the details; participants decide whether to join. You are responsible for evaluating Events, Hosts, other participants, conditions, and your own safety and fitness. Your participation is governed by the Participation Agreement. GetBeta does not verify users, perform background checks, or guarantee any Event, Host, or information. 6. MODERATION & ENFORCEMENT. We may, at our sole discretion and without notice, review, moderate, remove, or restrict content, and suspend, ban, or terminate accounts, for any reason, including violations of these Terms or to protect users or the Platform. We may cooperate with law enforcement. We have no obligation to monitor but may do so. You can report users, events, or content through the Platform, and we may act on reports at our discretion. 7. SAFETY & INTERACTIONS WITH OTHERS. GetBeta is not responsible for the conduct of any user, whether online or offline. You meet and interact with other people at your own risk. Use good judgment, meet in public where possible, tell someone your plans, and stop any activity that feels unsafe. For emergencies, contact local authorities. 8. THIRD-PARTY SERVICES. The Platform relies on and links to third-party services (for example, sign-in, maps, hosting, and email providers). We are not responsible for third-party services or content, and your use of them may be governed by their own terms. 9. FEES. The Platform is currently free to use. We may introduce paid features in the future; if we do, we will disclose the terms before you are charged. 10. DISCLAIMERS. THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE. 11. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, GETBETA AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). Nothing limits liability that cannot be limited under applicable law. These limits are in addition to those in the Participation Agreement. 12. INDEMNIFICATION. To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless GetBeta and its owners, members, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Platform, your User Content, your Events, your conduct, or your violation of these Terms or any law. 13. TERMINATION. You may stop using the Platform at any time. We may suspend or terminate your access at any time, with or without cause. Provisions that by their nature should survive termination will survive, including the license for already-distributed content, disclaimers, limitations of liability, indemnification, and dispute terms. 14. GOVERNING LAW & DISPUTES. These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules. Any dispute-resolution provisions (including any arbitration and class-action waiver) in the Participation Agreement also apply to disputes under these Terms. These Terms, the Privacy Policy, and the Participation Agreement are the entire agreement between you and GetBeta regarding the Platform.
